Buying agricultural land to build a home in Trinidad and Tobago

A plot offered as agricultural land needs careful investigation when the intended use is a home. Establish the rights being sold, the planning position and the physical requirements before committing to the purchase.

Request the seller’s documents

Ask for the title or lease, survey plan, previous TCPD decisions and any approved layout. Have the attorney establish the seller’s authority to transfer the interest. Ask the surveyor to identify the plot on the ground and relate it to the parent parcel.

Where the documents describe different areas or lot numbers, resolve the mismatch before relying on a price or a proposed house layout.

Get the planning answer in writing

Request Status of Land correspondence where the site’s policy and approval history are unclear. Give TCPD the exact proposal, including the number of dwellings and any land division.

Ask for the conditions and approved drawings behind any claim of residential approval. Read them with the professional advisers. A submitted application, an outline decision and a final approved development each represent a different stage.

Examine agricultural lease restrictions

For leased land, ask the attorney to check the term, permitted use and consent requirements for assignment, building and subdivision. Identify the administering authority for State land and obtain its written position on the proposed residential use.

Ask who must complete any outstanding lease documentation or consent before transfer and how the agreement will handle a refusal or delay.

Price the land together with the works it needs

Walk the site with the appropriate professionals. Investigate legal and physical access, drainage, slope, wastewater disposal and water supply. Ask for the likely design and infrastructure tasks before committing to a construction budget.

Keep the purchase price, approval work and infrastructure as separate entries in the budget. A low asking price leaves those costs to be investigated.

Have the attorney structure the purchase conditions

Give the attorney the intended use and the unresolved questions. Discuss which approvals or investigations should become conditions of the agreement, the time allowed, access for inspections and the treatment of the deposit.

Decide only after the written results have been reviewed. Retain the final file so the architect, engineer and contractor work from the same parcel information.

Take this checklist to the attorney, surveyor and planning adviser.

  • What legal interest is being transferred?
  • Does the seller have authority to sell it?
  • Does the survey identify the exact plot and legal access?
  • How was the plot created?
  • What residential use has TCPD actually approved?
  • What lease and planning conditions remain outstanding?
  • What infrastructure must be built and who pays for it?
  • What happens to the transaction if the required approval is refused?
